A Licensed Contractor may submit a Temporary Construction Fence application to the Department, in lieu of a Registered Design Professional when the application’s drawings indicate a design in accordance with Approved Board of Standards and Appeals (BSA) Minutes or when allowed by BC 3307.7.5 permits the installation of Temporary Construction Fences in connection with the construction or demolition of a one-, two-, or three-family buildings.
A temporary construction fence is required by the NYC Construction Code to protect the public against possible hazards related to ongoing construction. It is installed prior to commencement of the project work and removed at the completion of work, meeting code requirements for removal.

For one- and two-family dwellings, DOB does not require permits for fences 6-feet or less in height, and homeowners may install their own fencing. In residential locations, fences are not required between properties. The maximum height of fences in the front, rear, or side yards depends on the property's zoning regulations.
NYCDOT has a number of active street reconstruction projects (the “Sites”) ongoing at any time. In order to mitigate the disruption to pedestrians and cyclists, DOT Art will enhance the construction fence surrounding the Sites with art.
There are no required DOB inspections solely for the use of construction fences. However, there may be required DOB inspections for associated projects that utilize Temporary Construction Fences such as demolition or new construction. See other Project Guidelines for associated DOB Inspections.
